Ex-MLB All-Star Returns To Baseball After Prison Release

CARACAS, Venezuela -- Former major league pitcher Ugueth Urbina returned to baseball Friday after serving 7 1/2 years in prison for the attempted murder of five workers on his family's ranch.

Before taking the field in his native Venezuela to play for the Lions of Caracas, Urbina described himself as "more mature" and said he was "very excited to play baseball again."

"I'm excited to be here," Urbina told reporters at the University Stadium in Caracas, where the Lions played the Zulia Eagles.

The 38-year-old pitcher was released from prison Sunday after serving roughly half of his 14-year sentence for attempted murder during a dispute over a gun on Oct. 16, 2005.

Urbina was found guilty of attacking and injuring workers with a machete. Several other men participated in the attack at his family's ranch, located about 25 miles from Caracas.

Urbina, who pitched for the Montreal Expos, Boston Red Sox, Texas Rangers, Florida Marlins, Detroit Tigers and Philadelphia Phillies, has repeatedly denied involvement with the incident that landed him in prison, saying he was sleeping at the time of the attack.

A two-time All-Star, Urbina saved 237 big league games from 1995-2005. He had two saves in the 2003 World Series to help the Marlins beat the New York Yankees, and last pitched in the majors with the Phillies in 2005.

Urbina told reporters he hopes to play professional baseball in the United States again.

"The first order of business is pitching in Venezuela," he said.

Confidentiality instructions under attack by the NLRB and EEOC ...

by Jessica Satriano, Esq.

On July 30, 2012, in the Banner Health System case, the National Labor Relations Board (NLRB), issued a decision holding that a hospital violated Section 8(a)(1) of the National Labor Relations Act (NLRA) by asking employees who had filed a complaint not to discuss it with co-workers while the investigation was pending.

Shortly after, in a different case, the Buffalo regional office of the EEOC took a similar position: That a confidentiality instruction to an employee making a discrimination complaint would constitute unlawful interference with the employee?s efforts to oppose discrimination.

The EEOC view

EEOC guidance states that complaining about discrimination or harassment to anyone?including management, union officials, other employees or even reporters?is protected opposition.?An employer that tries to stop an employee from talking with others about alleged discrimination or harassment is vio...(register to read more)

Flame shells set Scottish reef ablaze with color

A huge, colorful shellfish reef discovered off Scotland's west coast could be the largest of its kind in the world, according to the Scottish government.

Packing at least 100 million bright-orange shells into 4.5 square miles (7.5 square kilometers), the living reef consists of flame shells, a rare saltwater clam found near Scotland. Neon-orange tentacles emerge from between the clam's paired shells, waving gently in the current.

The flame shell reef is located in Loch Alsh, a sea inlet between the Isle of Skye and the Scottish mainland. The overall population of flame shells in the inlet is likely to exceed 100 million and is the largest-known flame shell reef anywhere in the United Kingdom, the Scottish government said in a statement.

"This important discovery may be the largest grouping of flame shells anywhere in the world," Scottish Environment Secretary Richard Lochhead said in the statement. "And not only are flame shells beautiful to look at, these enigmatic shellfish form a reef that offers a safe and productive environment for many other species."

Flame shells (Limaria hians) build 'nests' by binding gravel and shells together with thin, wiry threads. The shellfish are around 1.5 inches (4 centimeters) in length and group together in such numbers that they cover the seabed with a feltlike organic reef of nest material several inches thick. Flame shell beds are found in only eight sites in Scottish waters.

  1. Science news from NBCNews.com

    1. The year's top ancient mysteries (and missteps)

The past year saw plenty of controversy over ancient mysteries ? and we're not just talking about Maya prophecies. So what happened to "Franken-saurus," the Gospel of Jesus' Wife and the plan to clone a woolly mammoth?

    2. Unselfish brain cells found in monkeys
    3. Starvation didn't wipe out saber-toothed cats
    4. Two new orchid species found

"There were some records of flame shells in Loch Alsh, but scientists had no idea of the bed's true size," said Ben James, marine survey and monitoring manager at Scottish Natural Heritage.

Heriot-Watt University in Edinburgh carried out the Loch Alsh survey on behalf of Marine Scotland.

"Too often, when we go out to check earlier records of a particular species or habitat, we find them damaged, struggling or even gone," said Dan Harries, a marine ecologist with the university's school of life sciences. "We are delighted that, in this instance, we found not just occasional patches, but a huge and thriving flame shell community extending right the way along the entrance narrows of Loch Alsh. This is a wonderful discovery for all concerned."

The Loch Alsh inlet was surveyed as part of a program to identify new Marine Protected Areas, which help defend marine habitat. The reef's discovery strengthens the case for proposing the inlet as a protected area, said Calum Duncan, Scotland program manager for the Marine Conservation Society.

Apricorn Velocity Solo X2

By Joel Santo Domingo

If you're still rocking the Apple Mac Pro because the Xeon(s) in it are more useful to you than the Core i7 in a new iMac, then you may want to add an SSD to keep your system feeling speedy. The Apricorn Velocity Solo X2 ($99 list) can add a speedy SSD to your Mac Pro or other tower PC, plus you won't have to use a 2.5-inch to 3.5-inch drive bay bracket. It's got a large appeal to a limited group of computer users, the very definition of a niche product.

Features
So you've maxed out the four drive bays in your Mac Pro with hard drives, or you've filled the internal SATA ports on your PC. You don't want to remove any of the installed drives, because maybe you've set them up together in a RAID configuration, or simply have data capacity you can't lose. What now? The Apricorn Velocity Solo X2 can be used to add a 2.5-inch drive plus another SATA 2.5/3.5-inch drive in a matter of minutes. It's a PCIe X2 card that fits on your motherboard in any PCIe X4 card slot or larger. That is, it can even fit in a PCIe X16 slot if that's the only one free.

Simply clip the 2.5-inch SSD (or hard drive) into the Velocity Solo X2's SATA port, screw the drive in with the included screws, and pop the card into your PC or Mac Pro's free PCIe slot. If you've never installed a PCIe card in your system, you may need someone looking over your shoulder. If you're an IT guy, it'll take five minutes. The drive comes up instantly when you boot the system back up, and the OS will ask you to format the drive. We used an OCZ Vertex 4 128GB drive for our test install, but you can use drives like the Seagate Momentus XT or Samsung SSD 830 Series (256GB) as well.

Once installed, you can use the drive as a scratch drive for your graphics programs like Adobe Premiere Pro or Photoshop, but you can also use the drive to install your OS and applications for an added boost of speed. The drive acts like any other hard drive you have connected to one of your motherboard's SATA ports.

Performance
Using the OCZ Vertex 4 128GB, we were able to get a stellar 451 MBps read and 437 MBps write speed on our AJA System test. This means that the combo of the Vertex drive and the Velocity Solo will certainly be a great tool for HD video editing. We also were able to get a blazing 10 second transfer on our drag and drop test. These speeds were faster than the external LaCie Little Big Disk 240GB SSD (Thunderbolt). This mean you won't have to feel jealous of your colleagues with their Thunderbolt-equipped iMacs.

Like the Apricorn Mac Array, the Velocity Solo X2 is an accessory that's made to extend the life of your Apple Mac Pro or other PCIe-equipped tower PC. Think of it as a product to help you speed up your already speedy system.

COMPARISON TABLE
Compare the Buffalo MiniStation Cobalt USB 3.0 with several other hard drive side by side.

Nelson Mandela "not yet fully recovered": spokesman

JOHANNESBURG (Reuters) - Former South African President Nelson Mandela is doing well after being discharged from hospital, although he is still not fully recovered, a government spokesman said on Thursday.

"He is not yet fully recovered, but he has sufficiently moved forward so that he can be discharged," Mac Maharaj told local broadcaster eNCA.

"He is sufficiently well to be home."

The 94-year-old anti-apartheid leader and Nobel Peace Prize laureate was discharged from the hospital on Wednesday, ending a nearly three-week stay during which he was treated for a lung infection and had surgery to remove gallstones.

Mandela, who has been in frail health for several years, is now receiving care at his suburban Johannesburg home.

Mandela has a history of lung problems dating back to when he contracted tuberculosis while in jail as a political prisoner. He spent 27 years in prison, including 18 years on the windswept Robben Island off Cape Town.

The former president was admitted to a Pretoria hospital on December 8 and this was his longest stay in a hospital since he was released from prison in 1990.

Current President Jacob Zuma visited Mandela on Christmas Day and said the former South African leader was doing much better, making progress and in good spirits.

Mandela was also admitted to a hospital in February because of abdominal pain but released the following day after a keyhole examination showed there was nothing seriously wrong with him.

He has spent most of his time since then in another home in Qunu, his ancestral village in the impoverished Eastern Cape province.

UK watchdog to probe BBC payoffs

(AP) ? Britain's public spending watchdog says it will investigate severance packages at the BBC in the wake of a highly-criticized payout to the broadcaster's former director general.

The probe comes after a group of British lawmakers accused the BBC of being cavalier with taxpayers' money by paying 450,000 pounds ($730,000) in severance to George Entwistle ? double the amount he was entitled to ? when he quit last month over the BBC's disastrous handling of fallout from the Jimmy Savile sex abuse scandal.

Barry Lester, a spokesman for the National Audit Office, said Wednesday the watchdog had written to the BBC saying it wanted to look at Entwistle's payout and that the broadcaster had responded by asking the NAO to undertake a wider study in 2013 on its severance packages.

Prasanna Jayawardene suffers hairline fracture to thumb ? Cricket News Update

Having experienced some bruising after he was struck on the top of his right thumb by a Mitchell Johnson delivery, Sri Lankan wicketkeeper batsman Prasanna Jayawardene was revealed to have suffered a hairline fracture, after he was dismissed during the first innings of Sri Lanka?s ongoing second Test against Australia, today on December 26 at the Melbourne Cricket Ground.

?There was some bruising on his thumb after his innings, so we thought we'd better check,? team manager Charith Senanayake has stated shortly after Jayawardene suffered the injury.

?It's a bit too early to tell and I'm still getting the information from the physio, [Prasanna] has had a nasty knock on the thumb and its? pretty tender and sore at the moment, but we'll get more information on that during the night,? Sri Lanka coach Graham Ford said.

Later in the day, X-rays revealed that the 33-year-old had, in fact, sustained a hairline fracture. The injury occurred after the right-hander was hit on the thumb by a bouncer from Johnson, after which the ball went on to bounce off the shoulder of his bat, right to a waiting Phillip Hughes in the slip cordon. Jayawardene made his exit in the 39th over, having contributed 24 runs to Sri Lanka?s paltry first innings total of 156.

With the wicketkeeper having been forced to pull out of the remainder of day one, Kumar Sangakkara donned the gloves in his stead. Whether Jayawardene will be keeping the wickets on the second day of play is yet to be determined by team management.

In addition to the unfortunate accident, Johnson caused plenty of damage to the rest of the Sri Lankan batting order on the first day of their second Test at Melbourne. Veteran batsman Kumar Sangakkara (58) remained the only batsman who managed to put up a fight, while the rest gave their wickets away cheaply. Johnson (14-2-63-4) spearheaded Australia?s attack, and supported by the efforts of Peter Siddle (8-1-30-2), debutant Jackson Bird (13-5-32-2), and off-spinner Nathan Lyon (5.4-0-23-2), succeeded in bowling the visiting Sri Lankan side out for a first innings total of 156.

Md. School Celebrates Anniversary With Family Tree ? CBS Baltimore

By DANIELLE E. GAINES
The Frederick News-Post

FREDERICK, Md. (AP) ? There are family trees ? and then there?s the Linganore High School family tree, a project the school started to celebrate its 50th anniversary.

A sprawling, whimsical painted tree across the windows of the front office has become a showcase for photos of Linganore alumni with family and friends who are also Lancers. The tree has grown steadily since it was started Nov. 1.

The group is sharing the photos on its Facebook page.

There are pictures from weddings, trips around the world and outings on the boat.

One of the school?s custodians, a 1971 graduate, submitted a photo of her two sons, who graduated in 1997 and 2003. Their father also graduated from the school in 1967.

Another couple, who graduated together and will be married next year, also submitted a photo.

The Cook family ? with graduates from `79, `02, `04, `06, `07 and soon-to-be `13 ? is listed as ?an LHS dynasty.?

There are many of them in town, joked Pam Knight, the school?s attendance secretary.

She jokes about when her family will require a whole branch of the tree. She graduated in 1982 and married a 1980 alumnus. They had three children ? two boys and a girl ? who were also Lancers. One grandchild is attending the preschool inside the school.

Knight plans to take family photos to submit to the tree this holiday. In total, there will be 15 or so alumni from the family together, she said.

Already, she?s submitted a photo of the seven Linganore graduates who work at her Frederick business, Soft Images Hair Salon.

Natalie Rebetsky, an English teacher at the school, has been coordinating the entries. She said there was a spike after Thanksgiving and she expects another spike at Christmas.

A 28-year veteran at the school, Rebetsky noticed how generations attend the school in an unusual way. ?I always said I?d have to retire when I started teaching children of students I?ve had before. That happened six years ago, and obviously I haven?t retired,? she said.

Rebetsky said the tree is a lovely reminder of the school?s roots.

?At Linganore, a lot of the graduates stay in the community. It?s such a warm feeling when you meet somebody ? and then you realize you?ve known them for a long time,? Rebetsky said.

The Kindle Fire HD

Kindle Fire HD

The Kindle Fire HD delivers a tablet experience many folks will love, but is it the right choice for me? Have a read and see what a total Android nerd thinks of Amazon's latest offering.

Amazon’s new Kindle tablets don’t get the attention that other Android tablets get. Android purists tend to scoff at them, thinking that the operating system being used -- a true custom fork of Android 4.0 -- is entirely too basic, lacking many of the features and customization settings that stock Android or the more traditional OEM builds like Sense or TouchWiz have.

But simple -- and consistent -- software has a place. Amazon’s removal of some of the more advanced parts of the Android OS are also part of the reason not much talk goes on about the Kindle Fire HD -- it tends to just work, and users have few issues they need to sort out. Amazon has perfected the K.I.S.S. (Keep It Simple, Stupid) philosophy of smart devices.

I’ve had both Kindle Fire HD devices here for a while, and have spent a good bit of time playing with the hardware and Amazon’s operating system as shipped. It’s time I put down a few words about them.

Red Hat CEO On Company's Growth - Business Insider

What does it feel like to be the CEO of a super-hot company as it crests the billion-dollar-revenue mark and grows to 5,000 employees?

Red Hat CEO Jim Whitehurst says that it's hard to notice the changes. Then something happens to make you realize you are the boss of a very big place.

"It creeps up on you," says Whitehurst with a laugh. "It's a little like boiling a frog in water. If you heat it up slowly, it never jumps out."

It's been a big year for Red Hat. It became the first open-source company to hit a billion dollars in annual revenues. Consequently, it's hiring like crazy, adding more than a thousand employees this year alone. It's slowly moving into fabulous new digs in downtown Raleigh, North Carolina, to accommodate everyone.

While some employees are already in the new building, Whitehurst isn't, yet. The building is being finished floor by floor, so he won't be in until March.

"The growth hit me recently," said Whitehurst. "I had gone to the new headquarters building downtown. I was supposed to film a public-service ad, advocating for public transportation. I got there 10 minutes early, so I'm standing in front of the new building. The people I was meeting arrived and said, 'Let's not film here, there's too much road noise.'"

So they all walked away to a quieter spot. But employees who'd spotted Whitehurst waiting outside wondered what was going on.

"Three weeks later, I hear this rampant rumor that I was hanging out down there because the security guard wouldn't let me up and I had him fired," Whitehurst laughs. "Anyone that knows me knows that story is ridiculous."

The story spread because it had a grain of truth: It's now become impossible for all Red Hat employees to know each other?even the CEO?by sight.

"Sometime over last couple of years, we've gotten big," he says. Those types of rumors are bound to happen.

Gunman who ambushed firefighters left note saying he wanted to 'kill people'

Officials provide the latest details on the ambush that killed two firefighters while responding to a blaze in Webster, New York.

By Andrew Mach and Jason White, NBC News

Updated at 12:30 p.m. ET:?Police in Webster, N.Y., say the man who ambushed firefighters with a blaze of gunfire, killing two, in upstate New York, left a three-page typewritten note saying he wanted to burn down the neighborhood and ?do what I like doing best, killing people.?

William Spengler, 62, opened fire on the volunteers as they responded to a blaze just before 6 a.m. ET Monday in a small cluster of homes along Lake Ontario in Webster, N.Y., police said.

Two firefighters, Police Lieutenant Michael Chiapperini and Tomasz Kaczowka, were shot dead during the incident.

Two firefighters, Police Lieutenant?Michael Chiapperini and?Tomasz Kaczowka, were shot dead during the incident, and Spengler killed himself as seven houses burned around him Monday. Two other firefighters,?Joseph Hofstetter and Theodore Scardino, were recovering Tuesday at a hospital in Rochester, N.Y.?

An off-duty police officer also was hit by gunfire as he drove past the scene. There was no immediate information on his condition available on Tuesday.?

Webster Police Chief Gerald Pickering said at a press briefing Tuesday that Spengler armed himself with three weapons and set his house afire to lure first responders into a death trap.

"It does appear that it was a trap that was set," Pickering said,?his voice breaking at times.??People who get up in the middle of the night to fight fires, they don?t expect to get shot and killed."

Spengler's note did not appear to offer a motive for attacking the firefighters, Pickering said.?

Despite being shot, one of the injured firefighters was able to flee from scene under his own power. But the others remained pinned down on the narrow strip of land between Lake Ontario and Irondequoit Bay until a SWAT team arrived.

As police closed in, Spengler took his own life with a gunshot wound to the head, Pickering said. He was convicted of manslaughter in 1981 after the death of his grandmother, Rose Spengler, 92, and was paroled in 1998. He remained under parole supervision until 2006, the Rochester Democrat and Chronicle reported.

Monroe County Sheriff's office

William Spengler, 62, is seen in this undated booking photo.

Spengler's 67-year-old sister Cheryl Spengler is unaccounted for, Pickering said.

Spengler lived in the house with his sister and mother, Arline, who died in October at the age of 91. Arline Spengler's obituary asked that memorial donations be made to the West Webster Fireman's Association.?

A former neighbor told The Associated Press that Spengler "loved his mama to death" and that he "couldn't stand" his sister. The neighbor said he thinks Spengler "went crazy" after his mother died.

Prior to Monday's shooting, Webster police had not had any run-ins with Spengler since he was paroled, they said.

Although Spengler could not legally own firearms as a convicted felon, investigators told NBC 10 News in Rochester that he was equipped with four whiskey bottles of gasoline, a pistol and an AR-15 type rifle with 30-shot magazine capability. One of the four magazines had been used. ?

After the shooting, the fire grew to engulf at seven homes and one motor vehicle.?

?These firemen are part of our family. You go into a fire with these guys. To see them go down with something like this is totally unexpected. We are in shock,? Billy Gross, fire commissioner for West Webster, told the?Democrat and Chronicle.

Dozens of area residents were evacuated, with police searching them as they left, the newspaper reported.

"Miserable thing to happen this time of year," Mark Johns, a state assemblyman who represents the area, told?local NBC station WHEC. Johns said he knew some of the firefighters who were shot.

New York Gov. Andrew Cuomo issued a statement after the shooting, offering his "deepest condolences."

?All of our thoughts and prayers go to the families and friends of those who were killed in this senseless act of violence," Cuomo said.??New York's first responders are true heroes as they time and again selflessly rush toward danger in order to keep our families and communities safe."

NBC's Tom Winter and Rosanna Arlia contributed to this report.

The Presence of Love Around the Family Tree at Christmas | Peace ...

The world is my family and I send this wish to all families to unite as one family.? Invite people to christmas not because they are alone but because you love to share your presence as your gift with them.?

I was invited as an ?orphan? and said politely that I prefer people to invite me for my company not because they feel I shouldn?t be alone.? I actually like being alone and don?t feel I am unloved if I am alone.?? For me every day is christmas, as I am present.?

What I do love about this time of year is that people are much more expressive to each other, I like to hear people say ?have a happy christmas? and smile.? It warms my heart when I see people connecting with the wider human family with warms and relaxation. I?d love to see this all year round. I understand people feel happier because now it is their time and they can play. Imagine doing that every day.?

The world is indeed my family, what makes people family is a connectedness of love.? People in my view have great potential and when they open their hearts, there is no present more valuable.

Enjoy this poem it is written for every family.

Family Tree

What does it mean the world is my family?
How can it be?
The world is a family?
Are we speaking of a species?
Or a particular group?
What does family mean?
Why are they my world?

We have come from the same root,
For the tree of life bears many fruit,
Depending on the quality of the soil,
Depending on the season,
Depending on the type of seed,
There are many varieties,
But a tree is a tree,
And all the branches are reaching for the sun,
As this is the sunlight of the happiness of life itself.

A branch cannot exist without the tree,
The trunk cannot exist without the soil,
Nor the leaves without the bud,
Yet each face has the bud of potential,
Assuming the conditions are optimum.

Sometimes we cannot see the forest for the trees,
Sometimes the forest is dark,
It is frightening as shadows loom large,
Yet the darkness is simply the absence of light,
The light is always present,
For life on earth needs light to survive,
For nothing exists in isolation of the other.

The human family is separated,
The human plight is desperate,
For many are cast out of home seeking greener pastures,
For ones survival depends on good fortune,
Yet the wealth exists within the familial bonds,
The terrain becomes hard and arduous when one leaves,
For one is searching for the root,
Without knowing that it has been left behind,
As the chord was severed.

Family knows that each is part of each other,
When parents are united,
The tree becomes strong and deeply rooted,
For the root draws up nutrients of values and joy,
Secure in belonging,
In the knowledge that one always has a home,
And can return to the tree,
To sing together,
Is the greatest gift a father can give to his sons,
Is the greatest moment a mother can give daughters,
As each reach out to enjoy the fruit of the others life experience without comparison or envy,
And not to throw out the bad fruit,
But to understand that what is rotten can be healed,
In the right conditions of unconditional love.

There has been much deforestation,
Many trees are dying with dis-ease,
For the root no longer knows the branches,
The leaves float on the winds of hope,
Sometimes never to return home,
For there is no home to return to,
When one judges harshly,
When one rejects mistakes,
When one is jealous of another?s love,
When one lives in the past as if real,
When one no longer communicates,
What was known becomes a stranger,
What was close becomes distant,
For when one flies home there is no where to land,
The environment has changed,
There is another family replacing the old,
Another wife,
Another husband,
And unless they see the branches of love in the other,
The other may be out on a limb,
That no longer supports their existence,
Providing temporary shelter from the sunlight of acceptance.

The truth is we are all one tree,
With many varieties,
Yet to embrace difference is to seek not to impose one?s imprint on another,
To simply understand that each branch curls and curves given different conditions,
Some resist the winds of change,
Others are shaped by them,
Yet each is living and alive with presence,
And the sand rubbing in the shell,
Creates the pearl of wisdom,
For one can never change another,
Only use their wisdom to see more in the other,
For to push away is to resist,
Unreal expectations end in disappointment,
Total acceptance of wins/losses without condition is the foundation well-spring,
Is the strong root of the family,
That loves unconditionally,
And that is my Christmas wish for you all.

Did David Gregory just violate D.C. gun law by ... - Legal Insurrection

It sure looks that way, unless the gun clip Gregory held up today was just a dummy prop.

I saw a number of tweets linking to this post David Gregory Violates DC Gun Law On National TV?quoting D.C. Official Code 7-2506.01 (emphasis in original):

b) No person in the District shall possess, sell, or transfer any large capacity ammunition feeding device regardless of whether the device is attached to a firearm. For the purposes of this subsection, the term ?large capacity ammunition feeding device? means a magazine, belt, drum, feed strip, or similar device that has a capacity of, or that can be readily restored or converted to accept, more than 10 rounds of ammunition. The term ?large capacity ammunition feeding device? shall not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

I confirmed via Westlaw that this is in fact existing D.C. law.? Here?s the entire section:

? 7-2506.01. Persons permitted to possess ammunition.

(a) No person shall possess ammunition in the District of Columbia unless:

(1) He is a licensed dealer pursuant to subchapter IV of this unit;

(2) He is an officer, agent, or employee of the District of Columbia or the United States of America, on duty and acting within the scope of his duties when possessing such ammunition;

(3) He is the holder of the valid registration certificate for a firearm of the same gauge or caliber as the ammunition he possesses; except, that no such person shall possess restricted pistol bullets; or

(4) He holds an ammunition collector?s certificate on September 24, 1976.

(b) No person in the District shall possess, sell, or transfer any large capacity ammunition feeding device regardless of whether the device is attached to a firearm.

Here is the segment of today?s Meet the Press show in which Gregory holds up what appears to be a high-capacity (i.e., more than 10 round) ammunition clip while interviewing Wayne LaPierre this morning:

Visit NBCNews.com for breaking news, world news, and news about the economy

I sent Gregory a tweet, and I?ll try to reach out to NBC News, and I?ll update if I can get NBC?s position on whether Gregory just violated the law. Maybe it was just a dummy clip, not a real one:

Update 5:15 p.m. ? It has been 4 hours since I emailed the two communications people at NBC News with responsibility for Meet the Press, and almost two hours since I emailed the S.V.P. of Communications and left a voice mail on her cell phone, but no response yet from NBC News.

(AP) ? Pope Benedict XVI marked Christmas Eve with Mass in St. Peter's Basilica and a pressing question: Will people find room in their hectic, technology-driven lives for children, the poor and God?

The pontiff also prayed that Israelis and Palestinians live in peace and freedom, and asked the faithful to pray for strife-torn Syria as well as Lebanon and Iraq.

The ceremony began at 10 p.m. local time Monday with the blare of trumpets, meant to symbolize Christian joy over the news of Christ's birth in Bethlehem. As midnight neared, chuch bells tolled throughout Rome, while inside the basilica, the sweet voices of the Vatican's boys' choir resounded joyously.

Christmas Eve Mass at the Vatican traditionally began at midnight, but the start time was moved up years ago so as to give the 85-year-old pontiff more time to rest before his Christmas Day speech. That address is to be delivered at midday Tuesday from the basilica's central balcony.

A smiling Benedict, dressed in gold-colored vestments, waved to photo-snapping pilgrims and applauding church-goers as he glided up the center aisle toward the ornate main altar of the cavernous basilica on a wheeled platform guided by white-gloved aides. The platform saves him energy.

In his homily, Benedict cited the Gospel account of Mary and Joseph finding no room at an inn and ending up in a stable which sheltered the baby Jesus. He urged people to reflect upon what they find time for in their busy, technology-driven lives.

"The great moral question of our attitude toward the homeless, toward refugees and migrants takes on a deeper dimension: Do we really have room for God when he seeks to enter under our roof? Do we have time and space for him?" the pope said.

"The faster we can move, the more efficient our time-saving appliances become, the less time we have. And God? The question of God never seems urgent," Benedict lamented.

The pope worried that "we are so 'full' of ourselves that there is no room left for God." He added, "that means there is no room for others either ? for children, for the poor, for the stranger."

With his voice a bit hoarse, and looking somewhat tired as the two-hour ceremony neared its end, Benedict decried that history has suffered through "misuse of religion," when belief in one God became a pretext for intolerance and violence. Still, he insisted that where God is "forgotten or even denied, there is no peace either."

"Let us pray that Israelis and Palestinians be able to live their lives in the peace of the one God and in freedom," the pope said.

Benedict also mentioned his hope for progress in Syria, which is mired in civil war, as well as Lebanon and Iraq.

Reflecting the Vatican's concern about the exodus of many fearful Christians from the Muslim-dominated Middle East, Benedict expressed hope that "Christians in those lands where our faith was born maybe be able to continue living there" and that Christians and Muslims "build up their countries side by side in God's peace."

Hours before the basilica Mass, Benedict lit a Christmas peace candle on the windowsill of his studio window overlooking St. Peter's Square.

(AP) ? People around the world are grieving with the residents of Newtown over the murders of 26 school children and staff, offering their support by sending toys, money and other gifts.

An outpouring of tens of thousands of teddy bears, Barbie dolls, soccer balls, board games and more has come from toy stores, organizations and individuals worldwide.

"It's their way of grieving. They say, 'I feel so bad, I just want to do something to reach out,'" said Bobbi Veach, who was helping Saturday at Edmond Town Hall, where all of Newtown's children were invited to choose a toy.

After the Sandy Hook Elementary School massacre Dec. 14, victims were still being buried Saturday. A service was held in Ogden, Utah, for 6-year-old Emilie Parker. Others were held in Connecticut for 7-year-old Josephine Gay and 6-year-old Ana Marquez-Greene.

The 20-year-old gunman, Adam Lanza, killed his mother earlier across town and took his own life after the school massacre. Police still don't know why he did it.

At religious services Sunday morning in Newtown, church leaders received standing ovations from parishioners they have been helping to cope with the tragedy.

"This has been the worst week of my life," said Monsignor Robert Weiss of the St. Rose of Lima Roman Catholic Church, which lost eight children and two adults in the massacre. He thanked the community for giving him strength to get through the week filled with funerals.

In a church bulletin, he urged people to go ahead and celebrate Christmas with prayers for hope, healing and peace.

"We know that some hearts in this town will be broken again on Christmas morning when that one special person is not there to open their gifts," he wrote.

The Rev. Kathleen Adams-Shepherd also received an ovation and kisses from a long line of parishioners at Trinity Episcopal Church. She offered a prayer for the 26 victims at the school as well as the gunman and his slain mother, Nancy Lanza.

Millions of dollars have poured into Newton in the aftermath of the tragedy. The United Way of Western Connecticut said the official fund for donations had $2.8 million in it on Saturday. Others sent envelopes stuffed with cash to pay for coffee at the general store, and a shipment of cupcakes arrived from a gourmet bakery in Beverly Hills, California.

The Postal Service reported a six-fold increase in mail in the town and set up a unique post office box to handle it. Some letters were addressed to the "First Responders" or just "The People of Newtown." One card arrived from Georgia addressed to "The families of 6 amazing women and 20 beloved angels." Many contained checks.

"This is just the proof of the love that's in this country," Postmaster Cathy Zieff said.

Peter Leone said he was busy at his Newtown General Store when he got a phone call from a woman in Alaska who wanted to give him her credit card number.

"She said, 'I'm paying for the next $500 of food that goes out your door,'" Leone said. "About a half hour later another gentleman called, I think from the West Coast, and he did the same thing for $2,000."

The basement of the town hall building resembled a toy store, with piles of stuffed animals, dolls, games, and other gifts. They all were inspected and examined by bomb-sniffing dogs. The children could choose whatever they wanted.

Newtown resident Amy Mangold, director of the local Parks and Recreation department, attended with her 12-year-old daughter, Cory. She acknowledged that most attendees could afford to buy their own gifts but said "this means people really care about what's happening here. They know we need comfort and want to heal."

Many people have placed flowers, candles and stuffed animals at makeshift memorials that have popped up all over town. Others are stopping by the Edmond Town Hall to drop off food, toys or cash. About 60,000 teddy bears were donated, said Ann Benoure, a social services caseworker who was working at the town hall.

Tom Mahoney, the building administrator who's in charge of handling gifts, said the town plans to donate whatever is left to shelters or other charities.

In addition to the town's official fund, other private funds have been set up. Former Sandy Hook student Ryan Kraft, who once was Lanza's babysitter, set up a fund with other alumni that has collected almost $150,000. It is earmarked for the Sandy Hook PTA.

Rabbi Shaul Praver of Congregation Adath Israel is raising money for a memorial to the victims. He said one man wrote a check for $52,000 for the project.

Several colleges, including the University of Connecticut, have set up scholarship funds for Sandy Hook students and relatives of victims.

Isabel Almeida of the local United Way said that while the town is grateful for all the support, it has no more room for gifts. She encouraged people to donate to others in memory of Sandy Hook victims.

"Send those teddy bears to a school in your community or an organization that serves low-income children, who are in need this holiday season, and do it in memory of our children," she said.

Short, Sweet And In Stealth Mode: Is Quip The Name Of Ex-Facebook CTO Bret Taylor?s Next Project?

Bret Taylor PictureWhen Bret Taylor announced last June that he would be leaving his role as CTO of Facebook to work on a startup with another ex-Googler, Kevin Gibbs, little else was divulged about what that project would be?– except, as he told?AllThingsD, that it might cover an area he does not understand well as a consumer, a little like, you know, when he helped create Google Maps.?Today, a little more news began to seep out: the startup appears to be called “Quip” and Taylor started to redirect his backchannel.org site to the quip.com domain, but with invitation-only, restricted access. We heard about this a little earlier, and while we were trying to get through to Taylor to ask more, it seems that Business Insider heard about it, too. Now Taylor has responded to us — essentially, to note that the buck stops here for now: “We aren’t releasing anything and aren’t yet talking about what we are working on,” he wrote in an email. “I will be happy to talk when we are, though.” And for good measure, he’s now closed that little backchannel.org loophole that redirects it to quip.com, and backchannel.org has been taken offline altogether. Before the quip.com redirect disappeared, a Google apps login screen noted that Quip requested permission to view your email address, view basic account information, and manage your contacts. But as we note above, access to this was restricted. BI notes some other details that it has found on quip.com: It appears the quip.com domain changed ownership December 7 of this year. Quip has quietly registered on Twitter. An iPad app by the same name was rebranded to Tweetglass back in July because a European entity was claiming trademark infringement. But as BI points out this might be unrelated to Quip.com. And here are the additional details I found: It appears that the Quip had a mini frenzy of activity this month. In addition to the domain switch, the @quip Twitter handle was only created on December 13. Between domain and Twitter registration, it seems that backchannel.org might have already started redirecting, attracting?a little attention?in the process. As for what Quip itself might be, there are still no clues. Quips, as you know, are funny, short, witty remarks, often responses.?It’s tempting to think that Taylor, who had co-founded the social network aggregator FriendFeed before it was sold to Facebook, and Gibbs, who had been the

Mayan apocalypse failure bad news for believers

You might expect the world not ending to be a cause for celebration. But for believers in doomsdays like Friday's supposed Mayan apocalypse, the continued existence of the planet can be quite traumatic.

Friday was widely rumored online to be the end of the world, a misunderstanding of a calendar used by the ancient Maya people. Although the Maya made no doomsday predictions, some modern individuals and groups claimed they had foretold the end on Dec. 21, 2012.

Because the doomsday predictions were largely grassroots and spread online, the fallout from their failure is likely to be more varied than in doomsdays past, said Stephen Kent, a University of Alberta sociologist. Most of the time, doomsday predictions are made by charismatic leaders, often in cultlike settings. [Tales of the 10 Craziest Cults]

"It appears that believers in the Mayan calendar apocalypse range from troubled individuals to groups following charismatic leaders," Kent told LiveScience. "Consequently, the fallout could be very complicated."

When the world won't end
After a failed doomsday, believers respond with a range of reactions, from disavowing their former apocalyptic beliefs to, surprisingly, believing more than ever. One classic reaction is the one made by Harold Camping, a radio preacher who first predicted Judgment Day in 1994. When that date didn't pan out, Camping made a common claim among doomsday prophets ? the math had been wrong, but the ultimate prophecy would still prove true. He then predicted a widely publicized Judgment Day in May 2011, which also failed to occur. After that failure, Camping claimed the Judgment Day had been "spiritual" in nature and that the world would still end in a few short months.

When that claim also failed, Camping finally admitted his error. Rationalizing and attempting to explain away failure is common among failed doomsday groups, said Lorenzo DiTommaso, a professor of religion at Concordia University in Montreal. In some cases, groups even claim that their prayers saved the world.?

The Mayan apocalypse is likely to be different, if only because the Internet is bursting with dozens of contradictory prophecies about the day, DiTommaso told LiveScience.

"There are so many different predictions ridered onto the 2012 phenomenon, everyone's going to have a different response," DiTommaso said. "And because it's not a leader or a church or a doctrine or Karl Marx forecasting what the future is going to be like, there's not going to be a leader against whom you can forecast your dissatisfaction."

Facing mortality
Doomsday believers tend to pick up and get on with their lives more successfully if they have strong networks of family and friends, Kent said. The grassroots nature of the Mayan apocalypse predictions is therefore troubling, he said.

"The isolated individuals who encounter these predictions on the Internet may be terribly alone," he said. Some may be "really quite lost" in the wake of the uneventful day.

"It's not just the usual suspects," said DiTommaso of the 2012 apocalypse believers. "Lots of people can buy into 2012 for different reasons."

Part of the reason that failed doomsdays can be so traumatic, Kent said, is that they appear to be a way that people grapple with their mortality. Believers usually think they'll survive the end, whether by being one of God's chosen people, by building an underground bunker, or by hitching a ride on a friendly UFO. If you survive the end of the world, Kent said, you never have to face your own death.

"The believers always predict that their special knowledge will allow them to survive, that they will escape the mortality that all of us face," Kent said. "And so far, everyone's been proven wrong on that fact."

However, hope springs eternal. Matching the dates of the Mayan calendar to our modern calendar is not an exact science, offering doomsday believers a "we got the math wrong" rationalization for the failed prediction.

Already, "there's a bit of chatter for 2015," DiTommaso said.

Kerry a familiar face on the world stage

(AP) ? Sen. John Kerry, President Barack Obama's pick for secretary of state, is a familiar face to the world leaders vital to American interests.

The son of a diplomat and Obama's unofficial envoy, Kerry spent hours walking around the palace in Kabul persuading Afghanistan President Hamid Karzai to agree to a runoff election in fall 2009. The relationship will be crucial in the coming months as the administration draws down U.S. forces after more than a decade of war.

In Pakistan, Kerry helped quell the anger after the U.S. incursion into the country to kill Osama bin Laden in May 2011. The uneasy ties between Washington and Islamabad will be a priority for Kerry at the State Department.

"He knows most of the world leaders," said Sen. Lindsey Graham, R-S.C. "So when he goes into a country he will be a known quantity."

The five-term Massachusetts senator has spent his entire congressional career on the Foreign Relations Committee, the last six as chairman. He has traveled extensively both as intrepid lawmaker and administration emissary.

Fulfilling a Kerry dream, Obama on Friday tapped the 69-year-old lawmaker, a decorated Vietnam War veteran and 2004 Democratic presidential nominee, to replace Secretary of State Hillary Rodham Clinton for the top job at Foggy Bottom.

"I think it's fair to say that few individuals know as many presidents and prime ministers, or grasp our foreign policies as firmly as John Kerry," Obama said in making the announcement. "And this makes him a perfect choice to guide American diplomacy in the years ahead."

Kerry is expected to sail to confirmation, with both Republicans and Democrats praising the nomination. His friend, Sen. John McCain, R-Ariz., jokingly referred to him as "Mr. Secretary" earlier this month, a remarkable turn as just eight years ago Republicans ridiculed Kerry as a wind-surfing, elitist flip-flopper in his bid for the White House.

While Kerry has tamped down diplomatic fires for Obama, he has stepped ahead of the administration on a handful of crises. He joined McCain as an early proponent of a more aggressive policy toward Libya, pushing for using military forces to impose a "no-fly zone" over Libya as Moammar Gadhafi's forces killed rebels and citizens.

He was one of the early voices calling for Egyptian President Hosni Mubarak to step down as the revolution roiled the nation last year.

That independent voice may be tempered once he takes over as the administration's top diplomat.

"He's going to find what it's like to be part of an administration," said Sen. Richard Burr, R-N.C. "John's going to adapt to this well. I think he spent a lot of his time grooming to be a good secretary of state. ... I don't see any downside this nomination."

During his tenure, Kerry has pushed for reducing the number of nuclear weapons, shepherding a U.S.-Russia treaty through the Senate in December 2010, and has cast climate change as a national security threat, joining forces with Republicans on legislation that faced too many obstacles to win congressional passage.

He has led delegations to Syria and met a few times with President Bashar Assad, now a pariah in U.S. eyes after months of civil war and bloodshed as the government looks to put down a people's rebellion. Figuring out an end-game for the Middle East country would demand all of Kerry's skills.

The selection of Kerry closes a political circle with Obama. In 2004, it was White House hopeful Kerry who asked a largely unknown Illinois state senator to deliver the keynote address at the Democratic convention in Boston, handing the national stage to Obama. Kerry lost that election to President George W. Bush. Four years later, Obama was the White House hopeful who succeeded where Kerry had failed.

Throughout this past election year, Kerry skewered Obama's Republican rival, Mitt Romney, at nearly every opportunity and was a vocal booster for the president's re-election. Kerry memorably told delegates at the Democratic National Convention in August: "Ask Osama bin Laden if he's better off now than he was four years ago."

Kerry and McCain, defeated presidential candidates who returned to the Senate, have joined forces repeatedly during the past few decades. In July 1995, the two decorated Vietnam War veterans provided political cover to President Bill Clinton when he normalized U.S. relations with Vietnam. Clinton had been dogged by questions about his lack of military service.

Kerry, the Yale graduate who enlisted in the Navy, was an appealing presidential nominee in 2004 for his Vietnam War service. Three years after the Sept. 11 terror attacks, national security credentials were critical against Bush.

But Kerry was pounded by the Swiftboat Veterans for Truth, a group that made unsubstantiated claims challenging Kerry's war record of a Silver Star, a Bronze Star for combat valor and three Purple Hearts. His candidacy also was dogged by his anti-war stance in April 1971 when he testified before the committee he would later chair and famously asked, "How do you ask a man to be the last man to die for a mistake?"

Kerry's move to the State Department will spark yet another special election in Massachusetts ? the third Senate contest since a 2010 special election following the death of Sen. Edward M. Kennedy in 2009.

Republican Sen. Scott Brown, who won the 2010 special election but lost last month to Democratic challenger Elizabeth Warren, is seen as a front-runner on the GOP side if he chooses to run again.

Possible Democratic candidates include Reps. Michael Capuano, Edward Markey and Stephen Lynch, and Ted Kennedy Jr., son of the late senator. Gov. Deval Patrick must name an interim senator to serve until the special election. Former Gov. Michael Dukakis and Victoria Kennedy, Edward M. Kennedy's widow, have been suggested as possible interim senators although Patrick hasn't publicly confirmed any names.

Kerry was in Pakistan last year in the midst of a diplomatic crisis after Raymond Davis, a CIA-contracted American spy, was accused of killing two Pakistanis.

Sen. Chris Coons, D-Del., a member of the Foreign Relations Committee, traveled to Pakistan around that time and recalled Kerry's influence.

"I arrived in Islamabad, I think, five days after Ray Davis had been taken into a jail in the Punjab and was at very real risk of being hauled out of the jail and lynched," Coons said. "Sen. Kerry was about to show up and negotiate on behalf of the administration. And it was clear that both the diplomats and the military folks we met with viewed him as a real man of credibility and experience who was likely to contribute meaningfully to those negotiations."

Davis pleaded self-defense. After weeks of wrangling between the U.S. and Pakistan, he was released in exchange for "blood money" paid to the dead men's relatives.

Sen. Bob Menendez, D-N.J., who likely will take over the chairmanship of the Foreign Relations Committee, said the high-level relationships that Kerry "built with world leaders will allow him to step seamlessly into the position and to ensure that there is no decline in U.S. leadership on important global issues during a transition."
